Terms of Use

By creating a FilmShelves account or using any part of the service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service.

You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use FilmShelves. You are responsible for keeping your login credentials secure and for any activity that occurs under your account.

You may hold one personal account. Sharing an account, or operating multiple accounts to evade limits or moderation, is not permitted.

FilmShelves maintains a shared catalogue of physical film releases. When you submit edits, suggestions, metadata, images, or other contributions to the catalogue, you grant FilmShelves a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use, store, reproduce, modify, publish, and display that contribution as part of the catalogue, including in features built on top of the catalogue.

You warrant that:

• you have the right to submit each contribution and to grant the licence above;
• your contributions do not infringe any third party's copyright, trademark, privacy, or other rights;
• catalogue images you upload (e.g. cover scans) are either your own work or used with permission, or fall within applicable copyright limitations such as fair dealing or fair use.

Factual catalogue data (release dates, formats, regions, distributors, runtimes) is not itself copyrightable. We publish the catalogue as a shared community reference.

Your collection, ratings, notes, lists, and other personal content remain yours. You grant FilmShelves a licence to host, store, display, and reproduce that content as needed to operate the service and to show it to the audience you choose (private, friends, or public). You can delete your personal content at any time via the service.

You agree not to:

• harass, threaten, defame, or impersonate any person;
• post content that is unlawful, hateful, or otherwise prohibited by applicable law (see also the "Child safety" section below);
• scrape, crawl, or otherwise extract data from the service at scale, or use automated tools that materially burden our infrastructure;
• attempt to gain unauthorised access to accounts, servers, or networks connected to the service;
• introduce malware, exploit security vulnerabilities, or interfere with the operation of the service;
• use the service to send unsolicited bulk messages or to promote unrelated commercial offers.

These Terms are the headline rules. Day-to-day behaviour expectations — what we encourage, what we'll remove, and how to report a problem — live in the Community Policy. The Community Policy is part of these Terms by reference, and breaking it counts as breaking these Terms.

We may remove content or restrict access where we reasonably believe these rules have been broken.

Some release pages include "where to buy" links to third-party retailers such as Amazon and eBay. These are affiliate links: FilmShelves participates in the Amazon Associates programme and the eBay Partner Network, and may earn a commission when you follow one of these links and make a purchase — at no additional cost to you.

We provide these links as a convenience to help you find a release. We are not the seller, and we are not responsible for the products, prices, availability, or purchase terms of any third-party retailer — that transaction is solely between you and the retailer, under their own terms and privacy policy. How we handle affiliate links is described further in our Privacy Policy.

FilmShelves has zero tolerance for child sexual abuse and exploitation (CSAE). Content that depicts, sexualises, grooms, or otherwise endangers a minor is strictly prohibited.

Accounts that share or facilitate such content will be terminated immediately. We report apparent CSAE to law enforcement and to the National Center for Missing & Exploited Children (NCMEC) or the relevant local authority where required by law.

If you encounter content of this kind on FilmShelves, report it via the in-app report tool or email safety@filmshelves.com immediately. Reports of this type are prioritised.

FilmShelves is a platform for personal collections and catalogue contributions. We are not the publisher of content that users post. We do not pre-screen every contribution, comment, review, or message — but we may, at our discretion, review, remove, or restrict any content that we reasonably believe breaks these Terms, the Community Policy, or applicable law. We are not obligated to take any particular moderation action.

We may suspend or terminate accounts that repeatedly or seriously break the rules. Where practical we will tell you why and give you a chance to respond first; in serious cases (including CSAE, threats, or active abuse) action may be immediate.

Some FilmShelves features may be offered on a paid basis. Pricing, billing cycles, and refund terms are described at the point of purchase. Payments are processed by Stripe; your card data is handled directly by Stripe and not stored by FilmShelves.

You can cancel a paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not pro-rate refunds for partial periods except where required by law.

FilmShelves, including the software, brand, design, and the compiled catalogue (as a whole), is owned by FilmShelves and its licensors. Nothing in these Terms transfers that ownership to you, except for the limited licence to use the service granted here.

You may close your account at any time via Settings. Closing your account deletes or anonymises your personal data as described in the Privacy Policy.

We may suspend or terminate your account if you breach these Terms, if your use of the service creates legal or safety risks, or if we are required to do so by law. Where practical we will give notice and a chance to address the issue first; in serious or repeated cases termination may be immediate.

The following sections survive termination of your account or these Terms: Catalogue contributions, Intellectual property, Feedback, Disclaimers, Limitation of liability, Indemnity, and Governing law and jurisdiction — along with any other provision that by its nature should reasonably survive.

If you send us ideas, suggestions, or feedback about the service (for example, feature requests or bug reports), we may use that feedback to improve FilmShelves without any obligation to you. You grant us a perpetual, irrevocable, worldwide, royalty-free licence to use feedback you send us for any purpose. Feedback you submit is not confidential.

The service is provided "as is" and "as available". FilmShelves does not warrant that the service will be uninterrupted, error-free, or that catalogue information is accurate or complete. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, FilmShelves will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service. Our total liability to you for all claims relating to the service is limited to the greater of (a) the amounts you paid to FilmShelves in the twelve months before the event giving rise to the claim, or (b) CAD $100.

You agree to indemnify and hold FilmShelves harmless from third-party claims arising out of your contributions, your breach of these Terms, or your misuse of the service, to the extent permitted by law.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada, for any dispute arising out of or relating to these Terms or the service, subject to any mandatory consumer-protection rights in your country of residence.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated in-app or by email before they take effect; continued use of the service after that point constitutes acceptance of the updated Terms.
